The principal question to be decided in this case is, whether, in an action upon an administrator’s bond, brought against the administrator and his securities, the fact of a *devastavit by the administrator can properly be put in issue and tried and determined. The statute 1 Hen. VIII., c. 5, directed the taking of surety for the true administration of goods, chattels, and debts. The statute of 22 and 23 Car.
