The petitioner in the second case, a dealer furnishing lumber to a contractor engaged in the construction of public works under a contract with the city of Boston, filed a petition in the Superior Court to establish a claim to security provided under G. L. (Ter. Ed.) c. 149, § 29, “for payment . . . for . . . materials used or employed in such construction.” The case was referred to a master who found that certain lumber of the value of $338.13 furnished by the petitioner to the contractor was used by the latter to make forms for the erection of concrete construction and was removed when the…
