MEMORANDUM OPINION

LEWIS A. KAPLAN, District Judge.

This action for damages and a declaration of rights under a prenuptial agree ment is before the Court on the defendant’s motion to dismiss on the ground of forum non conveniens or for insufficiency of service of process.

Facts

Plaintiff Alamir, a citizen of France, and defendant Callen, a United States citizen, entered into a prenuptial agreement and were married in Nice, France, on January 10, 2004.
