Proceeding pursuant to CPLR article 78 (transferred to this Court by order of the Supreme Court, entered in Albany County) to review a determination of respondent Comptroller which denied petitioner’s application for accidental disability retirement benefits.
Petitioner was employed as a senior criminal investigator for the Westchester County District Attorney’s office. During a firearms training exercise, he and his partner were directed by a range officer to follow a scenario requiring each to perform defensive maneuvers while firing live ammunition at a target representing a man with a gun.…
