Rebecca H. Rivers, as plaintiff, began her action in the Court of Common Pleas for Hampton County against C. M. Rivers, as executor, &c., of F. D. Rivers, deceased, Mary Ann Rivers, a minor, Jacob H. Rivers, J. M. Rivers, and Rebecca Matthews, as defendants, for the purpose of having the will of her husband, F. D. Rivers, construed, so that her interest thereunder might be ascertained and a trustee appointed to protect her estate.
