HOUGH, Circuit Judge.

There is little, if any, difference of opinion among the witnesses as to the leading facts in this case. The *271Hokendauqua made up her tow, went across the stream or river to get within hail of the naval patrol boat, and deliberately went to the north or port side of the channel between Throgg’s Neck and Willet’s Point, in order by that path to emerge into the open Sound. In order to follow the channel, or at least the ordinary course, so as to pass Stepping Stones Right to starboard and Execution Right to port (going eastward), it was necessary for the Hokendauqua to swing…
