*1403Appeal and cross appeal from a judgment (denominated order) of the Supreme Court, Erie County (Diane Y. Devlin, J.), entered November 10, 2015. The judgment, among other things, denied that part of the motion of third-party plaintiffs seeking attorneys’ fees and denied the cross motion of third-party defendant for summary judgment.

It is hereby ordered that the judgment so appealed from is unanimously modified on the law by granting that part of the motion seeking attorneys’ fees incurred in defending the underlying action, and as modified, the judgment is affirmed without costs, and the…
