The defendant, Raymond Hall, together with one Elliott Lewis, was indicted in the criminal court of Cook County for the crime of unlawfully selling narcotic drugs. Lewis was tried by jury and found guilty. At the conclusion of the jury trial, Hall, who had waived his right to a jury trial, stipulated that the evidence which had been heard by the jtiry in Lewis’s case, could be considered by the court as the evidence in his case. The court then entered a finding and judgment of guilty. The case is now here on a writ of error.
