Appeal from an order of the Supreme Court (Ferradme, J.), entered June 27, 2005 in Saratoga County, which granted defendant’s motion to dismiss the complaint.
Plaintiffs are the shareholders, officers and directors of Excel Hockey, a New York corporation doing business as “The Hockey Hut.” The Hockey Hut, located in the Town of Halfmoon, Saratoga County, is a year-round facility used for both ice skating and ice hockey training.
