FROM DAVIDSON. This cause was tried by a jury at the September Term, 1860. A verdict was rendered in favor of the defendants in error. Judge Nathaniel Baxter, presiding.

The question in this case, is as to the liability of the plaintiff in error, on a contract made by his wife. Mrs. Catron has a separate estate settled upon her, but the writing, or instrument under which she derives title, was not read in evidence, and the exact nature of the estate, or the power conferred upon her in regard to it, does not appear. Oral evidence of the existence of such an estate was received without objection, and the fact is conceded in argument, on both sides.
