IJ. P. Powell was proceeding to evict Erwin Powell from tbe possession of 53-1/3 acres of land known as the southwest 1/3 of lot No. 210 in the 12th district and fourth section of Walker County, and the defendants in error (Erwin Powell and Ms wife, Ella Powell) filed an equitable petition upon which a temporary restraining order was granted. Later, without any hearing having been had upon the temporary restraining order, the case came on for trial; and after overruling demurrers to the petition, the case proceeded to trial and at its conclusion the judge directed a verdict in…
