Cascade International Investment Co. v. Keene

This appeal is from a separate judgment in the action we considered in Cascade International Investment Co. v. Keene, 75 Or App 438, 707 P2d 610 (1985). The facts were set forth in that opinion, and we do not repeat them.

Trust I appeals from the judgment requiring it to specifically perform the land sale contract under which it is purchasing property from plaintiff. Trust I argues that plaintiff is not entitled to specific performance, because plaintiff is in the process of purchasing the property under the underlying Kreklau contract and does not have title to the property.
