The above-captioned cases have been consolidated for argument and for this *1166Court’s disposition on remand from the Supreme Court of Pennsylvania with regard to Petitioner Diana Giovagnoli’s petition for attorney fees pursuant to the Commonwealth Agency Adjudicatory Expenses Award Law, often referred to as the “Costs Act.”1
