MEMORANDUM OPINION AND ORDER

JUSTICE, District Judge.

In this civil action, the plaintiff attacks and the defendant seeks to protect certain business practices of Sperry and Hutchinson Company (hereinafter “S&H”), marketer of the familiar “S&H Green Stamps” that many merchants hand over to their customers as an incentive to do business with them.
