Jenkins, Justice.

In a previous petition by an executor, the court was asked to construe the will, in order to determine whether or not the wife of the testator, who was left a life-estate in the *820property, was authorized by the terms of the will to dispose of the property by a will of her own; and in the event that the will should be construed as giving her such power, the petition attacked her mental' capacity to make a will, and asked the court to declare null and void a will by which she sought to dispose of the property.
