The Illinois Secretary of State (Secretary) appeals from an order of the circuit court of Lake County, traffic division, directing the Secretary to issue a judicial driving permit (JDP) to the defendant, Michael Piat.

At issue is whether the circuit court erred in ordering the Secretary of State to issue a JDP to defendant after the Secretary had ordered a discretionary suspension of defendant’s driving privileges pursuant to section 6 — 206(a)(31) of the Illinois Vehicle Code (Code) (Ill.
