THIS MATTER comes before the Court upon the Notice of Settlement issued by the parties on July 21,1999 and the Objection thereto filed by the United States Trustee on August 16, 1999. The United States Trustee objects to the settlement on the basis that it is improper per se for a creditor to receive a private benefit to dismiss or settle a 11 U.S.C. § 727 1 action to the exclusion of the trustee and the other creditors and that the agreement by the parties to except the dischargeability of Plaintiffs debt pursuant to § 523 in this case may be such a…
