Mahoney, P. J.(1) Appeal from a judgment of the Supreme Court at Special Term (Tait, Jr., J.), entered April 3, 1985 in Madison County, which, in a proceeding pursuant to Lien Law § 201-a, granted respondent’s motion to dismiss the proceeding as untimely commenced, (2) motion to dismiss appeal as moot, and (3) cross motion to hold respondent in contempt of court.
