Defendants move to strike the bill which has been filed by Mrs. Rosalie Niemaseck, widow of Bernett A. Niemaseck and residuary devisee and legatee under his will.
The first, second, fifth and sixth causes of action stated in the bill show that testator, June 25th, 1930, caused the Bernett Holding Company to be incorporated and that he was at all times, until his death, the beneficial owner of all of its capital stock. The same day it was incorporated, he conveyed to it lands in Irvington and Newark, and the following year he procured one George Hayes to deed it other property on which testator…
