Erom a judgment entered on a verdict for plaintiff, the defendant appeals. Transferred from the Appellate Court under §1337u Burns 1901 (Acts 1901, p. 590, §1).

This is a suit by the appellee against the appellant on a policy of fire insurance upon a stock of goods owned by the appellee, destroyed by fire. Issues were formed, and a trial by the court resulted in a finding for the appellee in the sum of $1,000. A motion for a new trial was overruled, and judgment was rendered on the finding.
Errors are assigned (1) upon the refusal of the court to strike out parts of the second paragraph of the reply t'o the second paragraph of the answer; (2) the overruling of a demurrer to the second paragraph of the reply to the second paragraph.of the answer; (3)…
