The relator petitions this court for a peremptory writ of mandamus to compel the respondent, as state controller, to •draw his warrant on the state treasurer, in favor of relator, for the sum of $1,200, the sum appropriated for him by an act of the legislature entitled “An act to pay the deficiencies in the appropriations for the years 1895 and 1896,” approved February 16, 1897.
