Appeal from a decree of the Circuit Court of Baltimore City (Wickes, J.), sustaining a démurrer to the bill of com- , plaint in this case and dismissing the same. The cause was argued at the April Term, 1900, and was subsequently reargued by order of the Court at the October Term, 1900,before McSherry, C. J., Fowler, Briscoe, Page, Boyd, Pearce, Schmucker and Jones, JJ.

The American Casualty Insurance and Security Company became insolvent and was placed in the hands of receivers by a decree of the Circuit Court of Baltimore City on the 23rd of November, 1893. By order of Court the receivers have instituted several suits, among others the one now before us, to hold the directors of the company personally liable for negligence in the performance of their duties. While proceedings of this character are not frequent, the law appears to be well settled, in this State at least, that a Court of equity has jurisdiction to entertain a bill filed by a corporation to…
