This is an appeal by the state in a criminal case from an order of the trial court setting aside a plea of guilty to a felony charged fourteen days after the plea was received and sentence imposed. The record in the trial court may be summarized as follows: The appellee, J. H. Ni'chols, hereinafter referred to as defendant, was represented by Elmer C.
