In an action to recover damages for personal injuries based upon theories of negligence, products liability and breach of warranty, defendant Pal Pools, Inc., appeals from so much of an order of the Supreme Court, Nassau County (McGinity, J.), dated February 3, 1984, as denied its cross motion for summary judgment dismissing the complaint insofar as it is asserted against it.
