The relator, Marjorie L. Kirby, in the circuit court of Winnebago county, on November 22, 1934, filed her petition for writ of mandamus directed to the building inspector of the city of Rockford commanding him to issue a permit to her for the construction of a gasoline' filling and service station, together with other buildings, on lots 23, 24, 25 and 26 in block 2 of Evergreen Park subdivision in Rockford, owned by the relator.
