Appellee and two- others were jointly indicted charged with breaking into a warehouse with intent to' ¡steal therefrom property of value-.

On his separate trial he was acquitted under a peremptory instruction from the court, and the Commonwealth being dissatisfied with this action of the court, and with certain rulings on the admissibility of evidence *133which preceded it, has appealed to this court to have the law certified for future guidance.
