Defendant, who was found guilty of one count of depraved indifference murder, appeals from the denial of his motion to vacate the judgment of conviction in which he alleged that his trial counsel, Lynne Stewart,1 failed to provide him with effective assistance, in violation of his constitutional rights (CPL 440.10 [1] [h]). A Justice of this Court granted leave to appeal (CPL 460.15), and we now affirm.
