This was a prosecution for murder. Defendant was convicted by a jury; and after post-trial proceedings, he was sentenced to serve 25 to 75 years. To reverse his conviction, he appealed to the Supreme Court. There, he presented three issues. I. Whether the trial court deprived him of due process of law and fundamental fairness by restricting the time and the circumstances under which his lawyer could interview a surprise rebuttal witness.
