This was a criminal prosecution for an assault with intent to kill. The State of Kansas was the plaintiff, Chas. E. Scott was the defendant, and Herman Richner was the *69person alleged to have been assaulted. The defendant was convicted and sentenced, and he now appeals to this court. That the defendant shot Richner with a gun, loaded with shot, there can be no doubt; but still, the defendant claims that the transaction did not under the circumstances amount to a felonious assault.
