The respondent is informed against by the state’s-attorney for the unlawful sale of intoxicating liquor. The information contains eight counts. A general and special demurrer is interposed to’ the whole information, and also to each count. The information is based upon section sixty-eight of No. 90, Acts of 1902. The act was approved December 11, 1902. Therein it is provided, “Sec. 100. This act shall take effect on the first Tuesday of March, A. D., 1903, provided that if a majority of the ballots to be cast as hereinafter provided shall be No, then this act shall take effect the first…
