DOYLE, Judge.
O. B. Bandy, plaintiff in error, was informed against, tried, convicted, and sentenced to be confined in the county jail for a term of 30 days and pay a fine of $100 and costs for the crime of unlawfully selling intoxicating liquor. The judgment and sentence was pronounced on the 21st day of August, 1909, from which judgment and sentence an appeal was attempted to be taken by filing with the clerk of this court on December 30, 1909, a petition in error with case-made attached, and proof of service of the notices of appeal.
