STANLEY, District Judge.
This action was commenced on August 29, 1957, by Joseph Hiram Holt, Jr., a 15-year-old Negro citizen of Raleigh, North Carolina, and his parents, Joseph Hiram Holt and Elwyna Holt, against the Raleigh City Board of Education, to have declared the rights of the minor plaintiff to attend the public schools of the City of Raleigh without discrimination on account of race or color, and for an injunction restraining such discrimination.
