LATTIMORE, Judge.
Appellant was convicted in the District Court of Wharton County, of murder, and his punishment fixed at fifteen years confinement in the penitentiary.
The facts showed that Simon Grissom was an aged negro, living on a farm in Wharton County, with his second wife and their three children, the oldest of whom was deceased, a boy about eighteen years of age. The old man seems to have had numerous older children by a former wife. On the day before the homicide, as we understand the record, there was a difficulty between the old man and deceased, in which deceased struck his father…
