MOFFAT, Justice.

On the original hearing in this case, appellant directed the attack at three major propositions: (1) That the trial court was in error in finding that the transactions between Newton and Megeath constituted an open and mutual running account. In the original opinion herein (Newton v. Tracy Loan & Trust Co., 88 Utah 547, 40 P. (2d) 204, we sustained the trial court in its position as to that matter.
