Bedwell, J. —

The appellant, Flossie K. Bailey, filed an action in the court below against the appellees to recover the penalty provided for under the provisions of § 2 of ch. 47 of the Acts of 1885 (§ 10-902 Burns’ 1933), for the violation of what is usually denominated the “Civil Rights Statute” of this State. There was a trial by jury which returned a verdict for appellees.

The appellant, on appeal, is relying upon alleged error of the trial court in overruling her motion for a new trial, in striking out paragraphs two and four of her complaint, and in overruling her motion to approve and…
