In an action, inter alia, to recover damages for violation of General Business Law § 349, the defendant appeals from an order of the Supreme Court, Kings County (Schneier, J.), dated July 13, 2001, which denied its motion to dismiss the complaint and granted the plaintiffs cross motion for leave to serve an amended complaint.
Ordered that the order is reversed, on the law, with costs, the motion is granted, the cross motion is denied, and the complaint is dismissed.
