This case is before the court on a motion to withdraw the testimony from the jury and enter judgment for the-defendant.

The facts adduced in testimony by the plaintiff are that the defendant is the owner of a terrace apartment in which the plaintiff was a tenant; that the defendant contracted with one Heath, who is and has been in the business of interior decorating — including the refinishing of floors — for a period of from eight to twelve years, to refinish the floors in the suite occupied by the plaintiff.
