—In an action, inter alia, to recover damages for the payment of a check against insufficient funds, the plaintiff appeals, as limited by its brief, from so much of an order of the Supreme Court, Nassau County (Franco, J.), dated August 27, 1998 as denied its cross motion for summary judgment on the complaint.
Ordered that the order is modified, on the law, by deleting the provision thereof which denied that branch of the cross motion which was for summary judgment on the complaint against the defendant Jude Thaddeus Glen Cove Marina, Inc., and substituting therefor a provision granting that…
