Blackburn instituted an action against the Alabama Midland Railway Company, to recover damages for personal injuries which it is alleged he sustained by reason of the negligence of the servants of the company in the running and operation of a train of cars on its line of railroad. The trial resulted in a verdict for the plaintiff. The defendant filed a motion for a new trial, on the grounds that the verdict was contrary to law, contrary to the evidence, and without evidence to support it.
