This action was brought in the Municipal Court in the borough of Brooklyn to recover the sum of $500 brokerage commission, and upon the application of the defendant under the Municipal Court Act an order was made removing the case into this court.
Hpon the trial it appeared that the cause of action arose in the borough of Manhattan, and it affirmatively appeared and is beyond dispute that the defendant resided in the borough of Manhattan and never within the county of Kings.
