On November 11, 1998, plaintiffs Fayne A. Hildebrand and her husband, Andrew Hildebrand, commenced this lawsuit against defendant Wal-Mart Stores, Inc. in Connecticut Superior Court. On December 29, 1998, defendant removed this action to this District Court pursuant to 28 U.S.C. § § 1441(a) and 1446. (Dkt. # 1).
