Appeal from a judgment of the Appellate Division of the Supreme Court in the third judicial department, entered November 29, 1899, affirming a judgment in favor of plaintiff entered upon a verdict and an order denying a motion for a new trial. The parties entered into the following written contract:

“ 27ewbubgh, 27. Y., October 21, 1896.
“ The Laweence Cement Company, 27o. 1 Broadway, 27. Y.:
