In this original proceeding for a writ of habeas corpus, the petitioner seeks his release from the state penitentiary.

In June 23,1953, in the district court of Russell county, petitioner, being represented by counsel, entered his plea of guilty to one count of grand larceny and to two counts of burglary in the second degree. On the grand larceny charge he was sentenced to confinement for not more than five years (G. S. 1949, 21-534).
