MORGAN, District Judge.
In this CERCLA 1 case, the United States sought to recover from defendant North Landing Line Construction Company (“North Landing”) response costs incurred by the United States in response to the release or threatened release of hazardous waste at the Sutton Enterprise Superfund Site (“the Sutton Site”) in Chesapeake, Virginia.
