MEMORANDUM AND ORDER

CROW, Senior District Judge.

On September 21, 1999, the plaintiff, Timothy Paul Oblander, commenced this declaratory action in federal court. The plaintiff is represented by William K. Rork. On April 2, 1999, Oblander, a former deputy sheriff for Shawnee, County, Kansas, was charged in Shawnee County, Kansas, state district court with six counts of perjury. On May 28, 1999, Judge Parrish, the state district judge presiding over his state case, issued an order disqualifying Rork as defense counsel in Oblander’s state criminal case, finding that a serious conflict of interest…
