In this accounting proceeding the Hanover Bank as trustee under paragraph thirteenth of the last will and testament of John H. Gans has requested the court to construe the provisions of said paragraph and determine to *226what person or persons the property contained therein is distributable.

The first subparagraph of the thirteenth paragraph of said will directs that the residue of decedent’s estate be divided into three parts, one of which was to be held in trust for the benefit of his wife for life, and on her death to be divided amongst his issue in equal shares “ per stirpes…
