This matter is before this Court upon consolidated appeals 1 by the Division of Motor Vehicles, West Virginia Department of Transportation (hereinafter “DMV” or “Appellant”) from June 13, 2003, decisions of the Circuit Court of Lincoln County reversing the administrative drivers’ license revocations of Tommy Adkins and Tony J. Arbaugh (hereinafter “Appellees”) and remanding those cases to the DMV Commissioner for further proceedings.
