This cause is before this court on a motion of the defendants in error to dismiss the appeal.
The cause was tried on February 8, 1929, and a judgment was rendered by the court on February 9, 1929. A motion for new trial was filed and overruled on the same day. On February 14, 1929, the plaintiff died. A supersedeas bond was filed on February 22, 1929, in the name of the plaintiff, T. E. Powers. On May 4, 1929, the trial court granted the plaintiff additional time in which to make and serve a ease-made. On June 5, 1929, the case-made, naming T. E.
