Carl B. Donalson was charged with and indicted for the offenses of murder in violation of section 9 — 1 of the Criminal Code of 1961 (Ill. Rev. Stat. 1969, ch. 38, par. 9— 1), and of attempt armed robbery in violation of section 8 — 4 (Ill. Rev. Stat. 1969, ch. 38, par. 8—4). Following a jury trial, defendant was convicted of murder and attempt armed robbery. He was sentenced to a term of 20 to 40 years in the penitentiary for murder and did not receive a sentence for the conviction of attempt armed robbery.
