Jay Dee/Mole Joint Venture (“JDM”) 1 sued the Mayor and City Council of Baltimore and the Baltimore City Department of Public Works 2 (“DPW”) (collectively “the City”) for damages arising from the City’s alleged breach of a public construction contract. The City counterclaimed for breach of contract, liquidated damages, and promissory estoppel. Both JDM and the City have moved for summary judgment on JDM’s claims and on the City’s counterclaims for breach of contract and liquidated damages.
